Welcome to the General Terms & Conditions of Rooted Resilience!

1. Interpretation and Variation

1.1 In these General Terms and Conditions, the following definitions apply: "Rooted Resilience" means Rooted Resilience, registered trade name of Haskin Training & Consulting, registered under Chamber of Commerce (KvK) number 69767335 in Utrecht. "Participant" means any person who enters into a written or verbal agreement for one or more trainings with Rooted Resilience, has signed a registration form on the website, or checked the online disclaimer box accepted by Rooted Resilience. “Trainings” includes but is not exclusive of personal training, small group training, courses, classes, workshops, seminars, events, and/or coaching services. "Registration Form" means the registration and sign-up form on the website. "Website" means www.rootedresilience.nl. "General Terms and Conditions" as defined herein.

1.2 The General Terms and Conditions are on the website and in the registration form.

1.3 Rooted Resilience reserves the right to amend or revoke one or more of the General Terms and Conditions from time to time if it deems it necessary or appropriate for the regulation of the conduct and behavior of participants. Such changes will be published on the website and are binding on participants until revoked.

1.4 The General Terms and Conditions are governed by the laws of the Netherlands and fall under the exclusive jurisdiction of the Dutch courts.

2. Agreement

2.1 Subject to condition 2.2, when a person has agreed in writing, via the Registration Form, or ticked the terms and conditions online, they shall become a participant of the assigned training or event.

2.2 Acceptance of a person as a Participant is at the discretion of Rooted Resilience. 

2.3 Rooted Resilience expects respectful behavior from all participants. It reserves the right to withdraw, suspend or refuse to renew the agreement of any participant whose conduct is, or may deemed to be in the Rooted Resilience’s reasonable opinion, injurious to the character of the training, or amounts to a breach of the Terms and Conditions, or where such expulsion is otherwise in the best interests of the other participants of the training. Any participant so expelled shall forfeit all privileges to the agreement and shall not be entitled to any refund for any period during which his or her agreement is suspended.

2.4 Participation in all Rooted Resilience trainings is entirely at your own risk. The trainers and Rooted Resilience are not liable in any way for injury or accident during, before, or after training, except for gross negligence.

 

3. Events

Details of lesson dates, times, and locations may vary from time to time. All event details are published on our website.

4. Payment Terms & Cancellation Policy

4.1 Price details are available on our website or determined by Rooted Resilience from time to time.

4.2 Subject to any legal right of cancellation, payments for events and annual payments are non-refundable unless otherwise stated in the General Terms and Conditions.

4.3 When confirming your registration, Rooted Resilience will inform you when and how payment is due. If the participant fails to pay on time, Rooted Resilience is entitled to deny the participant access to the activity until payment has been received. In that case, the duration of the activity will not be extended by the duration of the suspension. The payment obligation remains in effect. Furthermore, all payments due for the remaining term of the agreement will become due and payable, and you must pay these to Rooted Resilience within 14 days of the due date. If Rooted Resilience is forced to collect its claim from you, you will also be liable for all extrajudicial collection costs and statutory interest. Unused but already paid sessions will, of course, continue. Rooted Resilience trainings and/or services are subject to 21% VAT. If costs increase due to unforeseen circumstances, Rooted Resilience is entitled to increase prices.

4.4 For business workshops and/or in-company training, payment is made within 30 days of the start of the training based on the invoice. The cancellation period is up to 21 days before the scheduled date; within those 21 days, the full amount is invoiced and paid by the organization. Rooted Resilience provides appropriate training materials; no additional costs are charged to the client for this.

4.5 All trainings (courses, clinics, workshops, events, personal training, or other services listed on the website) are non-refundable. Personal Training sessions require a minimum of 24 hours advance notice in order to be credited for future use. All Personal Training sessions cancelled within 24 hours will be charged to the participant. For self-defense 6-week courses, Rooted Resilience may credit a participant’s account if notice of unforeseen circumstances is given at least 7 days before the event start date (exceptions for certain medical/personal circumstances at the discretion of Rooted Resilience). However, deposits are non-refundable.

4.6 If trainings, workshops, seminars, courses or events offered on our website do not reach the minimum of 6 participants, the training may be cancelled at the sole discretion of Rooted Resilience. In this case the participant's registration will be automatically transferred to the next coming training date. When this date is not suitable for the participant, he/she can apply for a refund within 6 months; after 6 months all payments are non-refundable.

4.7 Force majeure with regard to the agreement is understood to mean everything that is understood in law and case law. Rooted Resilience is not bound by its obligations under the agreement if fulfillment becomes impossible due to force majeure. In the event of illness of our trainers / instructors, or insufficient interest in a group lesson, Rooted Resilience reserves the right to cancel the relevant activity(ies). An alternative will be sought in consultation. Training may be cancelled in hazardous weather conditions, including thunderstorms, storms, extreme heat, snow, or icy conditions. Activities are cancelled on public holidays.

5. Personal Belongings

All personal belongings brought to a Rooted Resilience training and/or service are at your own risk. Rooted Resilience accepts no liability for loss, damage or theft of such items.

6. Fitness & Health

6.1 Your safety and wellbeing are of the utmost importance to Rooted Resilience. Participants are responsible for disclosing any injuries, conditions or health concerns before engaging in trainings.

6.2 Participants are advised not to undertake strenuous physical activities without first seeking medical advice if they are concerned about their physical condition. Rooted Resilience reserves the right to refuse access to any participant if, in its absolute judgment, the participant's health may be endangered by participating in training.

6.3 If you experience PTS/PTSD, please contact your treating psychologist/psychiatrist before participating in our self-defense training. We request you to inform Rooted Resilience about this at least 14 days in advance of the start date of a training and/or service.

6.4 It is strongly recommended that participants hold their own personal health, accident, and/or liability insurance at their own cost.

6.5 Participants must follow the trainer's instructions at all times.

7. Clothing 

7.1 Participants are requested to wear clothing suitable for the activity. 

7.2 During group courses, participants are required to wear sports clothing during class, including a t-shirt (no tank top), sports shorts or pants, and sports shoes without black soles that leave marks or barefoot, depending on the floor of the training room. 

7.3 To protect fellow participants, equipment, and floors, Rooted Resilience may require a participant to wear protective materials, clothing, or footwear during training that meets our requirements. The costs of any replacement materials, clothing, or footwear are the responsibility of the participant.

8. Safety and Hygiene

8.1 Wearing jewelry during training is prohibited for safety reasons.

8.2 Wearing glasses/contact lenses or sports watches/fitness trackers is at your own risk. Rooted Resilience is not liable for personal injuries sustained nor for damage, loss, or theft of these personal items.

8.3 Changes in health conditions must be communicated to the trainer before and/or during training. It is not allowed to leave the training room during training without informing the trainer for safety reasons.

8.4 In case of fire, participants are asked to proceed to the nearest available exit.

9. General Guidelines

9.1 Participants must always adhere to the guidelines of Rooted Resilience trainers, which may be communicated to them from time to time, and are requested to comply with reasonable instructions that the trainer may give to ensure the smooth operation of the training for the convenience of all participants.

9.2 Rooted Resilience reserves the right to refuse access to the training facility. Costs already paid are not refundable by Rooted Resilience.

9.3 Rooted Resilience may, if a participant wishes, communicate via email. By providing an email address to Rooted Resilience, the Participant agrees to receive email communication from Rooted Resilience, including notice according to the General Terms and Conditions. The Participant also accepts any risk that email may not be a fully secure and confidential means of communication. Rooted Resilience is not liable for any loss or damage resulting from communication with a participant in this way.

9.4 The minimum age for participants is sixteen (16) years. For anyone under 16, specific seminars for children or teenagers are organized, and attendance with, or consent from a parent or legal guardian is required by registering for a training via the website or as agreed via email.

9.5 All material offered by Rooted Resilience may not be passed on to third parties and/or practiced with third parties without the written consent of Rooted Resilience. All self-defense techniques may only be used in training, for personal self-defense, or to protect loved ones, with due regard to Dutch legislation.

9.6 When you sign up for a Rooted Resilience self-defense 6-week course, you are expected to attend all 6 lessons. In the first 5 weeks, we work towards lesson 6, which includes an exam. If you miss two lessons or more, you are not eligible to participate in the exam because we cannot adequately prepare you when so much information and practice has been missed. The self-defense 6-week courses do not allow extra time to catch up on missed content in later lessons with your group. Rooted Resilience will, to the best of its ability and availability, offer the opportunity to make up a missed lesson with a Personal Training session, for an additional fee of at least seventy-five (75) euros.

9.7 When you sign up for a personal training, Rooted Resilience will schedule an appointment in consultation with the participant. If, for any reason, a specific time cannot be accommodated, Rooted Resilience reserves the right to reschedule the appointment in consultation with the participant. Both Rooted Resilience and the participant must be notified 24 hours in advance.

10. Narcotics

The use or sale of hard and soft drugs, stimulants, and all other substances falling under doping laws are strictly prohibited. Smoking at the location where the training is given is also prohibited.

11. Limitation of Liability

11.1 Rooted Resilience cannot be held responsible for any service or equipment that is not available for any reason. Rooted Resilience reserves the right to make changes to the types of facilities offered without notice and at its sole discretion. Rooted Resilience is not liable for any loss caused by such changes, except to the extent that loss cannot be excluded by law.

11.2 Participation in Rooted Resilience trainings is entirely at the participant’s risk. Rooted Resilience is not liable for any injury or other damage that participants may sustain during or as a result of training. Training advice is always non-binding and is followed at your own risk. Rooted Resilience is also not liable for damage to and/or loss of personal property, regardless of the cause, arising during or in connection with activities organized by Rooted Resilience. Rooted Resilience is not liable if the participant suffers damage in any other way and this damage is attributable to failure to follow oral or written instructions given by a Rooted Resilience trainer / instructor, or to the physical or mental condition of the participant. The participant hereby declares that he or she will receive all training solely and exclusively at his or her own risk. The costs of any accident or injury will be borne entirely by him or her. The participant hereby declares that they waive all rights to sue Rooted Resilience for compensation for costs, damages, and interest resulting from any accident or injury resulting from the performance of services offered by Rooted Resilience.

11.3 The participant is liable to Rooted Resilience for any damage suffered by Rooted Resilience that is attributable to the participant's failure to follow the trainer / instructor’s oral or written instructions.

11.4 The participant must indemnify Rooted Resilience for any damage they cause to other participants.

12. Website Terms and Conditions

12.1 Information published on this website is intended for the use of its visitors, and you are reminded that, although care has been taken in technical and factual accuracy, errors may occur. Rooted Resilience is not liable for the use by any party of the information on this website. 13. Privacy and Security Policy

Rooted Resilience thanks you for the trust you place in us, and we promise to handle your personal data with care. Rooted Resilience believes that protecting the privacy of its participants, clients, and website visitors is paramount to its operations. To provide you with excellent, personalized service, we require your information. Your personally identifiable information is securely stored. Only authorized employees, agents, and contractors (who have agreed to keep information safe and confidential) have access to this information. All emails and newsletters from our sites provide you with the option to unsubscribe from further mailings.

14. Intellectual Property

14.1 All training materials, class content, videos, written guides, branding elements (including logos, business name, and designs), and any other intellectual property created by or for Rooted Resistance are the sole property of Rooted Resistance unless otherwise agreed in writing. Unauthorized use of Rooted Resistance’s intellectual property may result in legal action.

14.2 Participation in any training or session does not grant clients or third parties any ownership or usage rights to Rooted Resistance’s intellectual property, beyond personal use for training purposes. Clients may not reproduce, distribute, share, or use any of the above-mentioned materials for commercial purposes without express written permission from Rooted Resistance.

14.3 Rooted Resistance retains the right to use, adapt, and distribute materials created by external contractors or collaborators when such use is granted through written agreement. All usage will comply with the scope and terms set out in each individual agreement..

15. Disputes

Participants can contact Rooted Resilience with any complaints. All disputes arising from the agreement to which these conditions apply or arising from further agreements related thereto will initially be exclusively submitted to the cantonal court of the statutory seat of Rooted Resilience or the district court, without prejudice to the right of appeal. Dutch law applies in all cases.
